The obligation applies to *individuals* if they receive $10k+ in the course of their trade or business, not just "businesses." So, if I'm a miner (even as an individual) I'm covered. Also, if I'm a day trader (even as an individual) I'm covered. If I'm an NFT artist it would also cover me even if I don't have an incorporated business, etc. Again, it is not just "businesses" that must comply but individuals too if they receive the funds in the course of their trade or business.
That all said, what constitutes "trade or business"? Well, it's not exactly clear from Treasury guidance to date. No clear bright line rule that I can find. We point this out in our lawsuit:

@brianmosher99 I'm not a securities lawyer, but I'm very confident that doing this would require a very stringent regulatory approval process. Without which the whole thing is pointless - why would I buy stock coins if there's a risk that the SEC closes the whole thing down tomorrow?
Would be a regulatory headache, but interesting to see if it could be implemented.
No one is paying $50 transaction fees to trade stocks on $ETH. Why would I, when I can trade from my brokerage account with fees of $0? But on $SOL, transaction fees ARE essentially $0.
