It's more common nowadays for discussions about "Off-Market" real estate sales. In days past, this typically meant a property that wasn't publicly listed and sold privately. That can still be the case, but with the new dawn of "Private Listings, Office Exclusives, or Private Placement Listings" this expands the definition of Off-Market to include multiple types of properties that skip the public advertising usually associated with traditional listings. The article linked below offers some insight into this new landscape.

1) One thing for sure is that the "Traditional" listing method has become much more involved over the years and isn't for everyone. But that does NOT mean these folks don't want to sell.
2) "Off-Market" no longer means "secret deals" but they can absolutely be private home sales that are not even "privately" listed in some fashion.
3) Private Listings (and Private Sales as well) can attract more discerning Buyers who want to participate in pursuit of homes with less overall competition and the possibility of more direct negotiations.
4) Off-market does not automatically mean FSBO (For Sale By Owner), but that is absolutely possible. If you're a Seller taking this route you have to be super careful as the legal issues in real estate sales become more complex.
5) Off-Market used to frequently be associated with limited or no appraisals, in fact, using an appraisal as a guideline as a potential seller can save a lot of headaches. Especially true if your Buyer is financing and likely be required to have one, and even savvy cash Buyers use them to make sure they not grossly overpaying.
6) Just like Traditional listings, overpricing can also derail Private sales too. See #5 above as a way to help set a good opening price, you won't regret it.
7) Off-Market sales do NOT mean less disclosures. In fact, if you're a Seller or a Buyer in an Off-Market sale that's not the result of a Private Listing, it's a good idea to use a Realtorยฎ, even if only in a transactional capacity to be sure these and other major milestones are met.
8) Off-Market opportunities can lead to fewer offers, and frankly that can be part of the appeal. Buyers who seek out and pursue off-market sales are not looking to pay LESS, they're often just trying to guard against being artificially leveraged too high
9) Off-Market properties can lead to more cash buyers who prefer the more direct, streamlined transaction type. Does that mean Off-Market deals are not for you if financing? Of COURSE not!

In chess, every piece has its' own individual moves, they have their own individual abilities, and each plays a different role in the overall strategy and eventual outcome.

In the article linked below, it's reported that investors stepped up their purchasing slightly in 2025 to about 11.3% of purchases. The more appealing part of that data is that "mom and pop" (0wners of 10 or fewer properties) investors once again dominated that market segment. While that may not appear beneficial, consider how much easier it is to buy from a mom and pop owner than it is from an institutional owner (owner of 350 or more properties).

Smaller investors present a more realistic opportunity of selling to an individual versus an institutional type f investor, who often sell in the same fashion they buy, in bulk portfolio sales. So even as potential legislation emerges to further curtail institutional investors, this will strengthen the hands of smaller investors. In turn, it can potentially create more buying opportunities for individual investors as well.
It's been said that inside every cloud there's a silver lining somewhere to be found. In this particular case, that lining is that smaller investors, who've always dominated the market by percentage, represent a more realistic opportunity for potential buyers who don't want to sit on their hands hoping that a listing or two appears. We just want to try and provide the tools to approach them. Yeah, we're different.
