@AdityaBirlaGrp I, Mr. Prakash Rudani, hereby serve this legal notice regarding the unsatisfactory painting services and defective workmanship carried out using Birla Opus products at my residence. Paint work LD 00435979
The painting work was completed recently(9th may 2026 with the expectation that the products and workmanship would meet the quality standards represented by Birla Opus and would be covered under the applicable warranty.
However, within a short period after completion, I observed numerous defects across multiple walls and ceilings, including but not limited to:
Hairline cracks
Visible cracks in paint/plaster
Peeling and flaking paint
Blistering/bubbling
Surface undulations and uneven finish
Shade variation and patchiness
Poor finishing around ceilings, corners and electrical fittings
These defects are evident throughout the property and materially affect both the appearance and quality of the finished work.
I have thoroughly documented these defects through photographs and have also prepared a detailed inspection report identifying each observed deficiency. Copies of these documents are available and can be furnished for your inspection.
The above defects indicate one or more of the following:
Improper surface preparation
Defective application process
Poor workmanship
Failure to follow prescribed painting specifications
Failure of the paint system and/or associated materials
Despite purchasing a premium painting solution from Birla Opus, the quality delivered falls significantly below the standards reasonably expected by a consumer.
This amounts to:
Deficiency in service under Section 2(11) of the Consumer Protection Act, 2019.
Defective goods, if the paint system itself has failed.
Failure to honour the representations and warranty associated with the product and service.
Accordingly, I call upon Birla Opus to:
Arrange a joint technical inspection of my premises by an authorised technical representative within 7 days of receipt of this notice.
Submit a written inspection report identifying the root cause of each defect.
Rectify all defects at your own cost, including complete surface preparation, crack treatment, primer application and repainting wherever required.
Replace any defective materials found during inspection.
Confirm in writing that the rectification work shall continue to remain covered under the applicable warranty.
Reimburse any incidental expenses incurred due to these defects, if applicable.
Please treat this notice as a final opportunity to resolve the matter amicably.
If I do not receive a satisfactory response within 7 days from the date of receipt of this notice, I shall be constrained to initiate appropriate legal proceedings before the competent District Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019. I shall also seek:
Complete rectification or replacement of the defective work;
Compensation for financial loss, inconvenience and mental agony;
Litigation costs;
Any other relief deemed fit by the Hon'ble Commission.
Nothing contained in this notice shall be construed as a waiver of any of my legal or equitable rights, all of which are expressly reserved.
