Finally… Sanity Prevails!

CBDT ne आखिरकार राहत दे ही दी - Tax Audit Report की तारीख 10 नवम्बर 2025 तक और ITR filing की तारीख 10 दिसम्बर 2025 तक बढ़ाई गई है।

पर सच्चाई यह है कि ये राहत बहुत देर से आई है।
हर साल वही कहानी दोहराई जाती है - professionals लगातार appeal करते हैं, representations भेजे जाते हैं, ground reality बताई जाती है, लेकिन निर्णय हमेशा आख़िरी minute पर ही लिया जाता है।

त्योहारों का सीज़न हो, GST filings का दबाव हो, TDS payments की deadlines हों, या ROC compliances - सब कुछ एक साथ चलता है।

और इसी बीच Tax audit reports और ITR filings का बोझ, बिना किसी clarity या timely communication के, पूरे tax fraternity पर डाल दिया जाता है।

कई छोटे practitioners, छोटे towns और cities में काम करने वाले CAs को systems, clients aur staff constraints के कारण पहले ही बहुत कठिनाई होती है।

जब due dates आख़िरी दिनों में होती हैं, तो न तो quality maintain रह पाती है और न ही mental health। फिर भी हर साल वही pattern:
👉 Appeals by professionals
👉 Silence from CBDT
👉 And finally, an 11th-hour extension!

क्या ऐसा होना चाहिए?
इतना बड़ा compliance ecosystem, जिसमें लाखों assessees aur professionals जुड़े हों, क्या वो predictable और transparent deadlines deserve नहीं करता?

Festive season में जब पूरा देश अपने परिवार के साथ समय बिताना चाहता है, तब CA fraternity sleepless nights गुजार रही होती है - clients ke calls, portal issues, errors aur anxiety ke बीच। और irony ये कि जब extension आती भी है, तो तब जब सारे लोग almost finish line पर पहुँच चुके होते हैं।

थोड़ा empathy, थोड़ा foresight aur थोड़ा planning अगर दिखाई जाए, तो ये वार्षिक “extension drama” हमेशा के लिए खत्म हो सकता है। CBDT ko ये समझना चाहिए कि timely decision lena कोई favour नहीं, बल्कि administrative responsibility है।

Relief mila है, हाँ - पर सवाल वही है: क्या इतना सीधा और logical फैसला इतनी देर से ही लेना पड़ता है? क्या tax professionals को हर साल इसी तरह uncertainty और stress का सामना करना पड़ेगा?

Professional community ne हमेशा system ke साथ collaborate किया है, reforms ko support किया है, aur compliance culture ko strengthen किया है पर बदले में उन्हें मिलनी चाहिए clarity, respect aur timely action.

🕰️ Yes, extension is granted… but once again, at the cost of sanity, sleep and stability of the compliance community.

अब वक़्त आ गया है कि CBDT और Finance Ministry इस pattern को तोड़ें - timely communication और practical approach अपनाएं।

कानून का मकसद लोगों को परेशान करना नहीं, बल्कि compliance को सहज बनाना है।
CBDT must act with foresight, not afterthought. 🙏

जब Gujarat High Court ने यह स्पष्ट कर दिया है कि जब Tax Audit Report की तारीख़ 30 सितम्बर से बढ़ाकर 31 अक्टूबर कर दी गई है, तो Income Tax Return की due date भी स्वाभाविक रूप से एक माह बाद अर्थात् 30 नवम्बर 2025 तक बढ़ाई जानी चाहिए, तब यह प्रश्न और भी गहरा हो जाता है कि CBDT ने अभी तक ऐसा क्यों नहीं किया?

Income Tax Act की धाराएँ 44AB और 139(1) स्पष्ट रूप से यह दर्शाती हैं कि Audit Report और ITR Filing का chronological इफेक्ट है - पहले Audit, फिर Return। ऐसे में अगर Audit की तारीख़ बढ़ाई गई है तो Return की due date भी logically और legally एक माह आगे बढ़नी चाहिए।

Court ने माना कि यह non extension न केवल अनुचित है बल्कि taxpayers और professionals पर अनावश्यक दबाव डालती है।

अब जब High Court ने स्वयं यह principle स्थापित किया है कि “1 month extension” दिया जाना चाहिए, तो अगर CBDT इसके बावजूद कोई कदम नहीं उठाता, तो यह प्रश्न उठना स्वाभाविक है कि क्या यह न्यायालय की भावना की अवहेलना या कहें तो contempt of court की श्रेणी में नहीं आता?

Audit Reports भले ही लगभग पूरी हो रही हों, पर Diwali season, staff shortage, और compliance pressure के बीच लाखों assessees के लिए ITR Filing practically संभव नहीं है।

इसलिए यह अपेक्षा स्वाभाविक है कि CBDT कानून की मंशा और न्यायालय के आदेश का सम्मान करते हुए due date को 30 नवम्बर 2025 तक बढ़ाए ताकि professionals और taxpayers दोनों शांति और संतुलन के साथ काम कर सकें, और compliance की गुणवत्ता भी बनी रहे।

ऐसा लग रहा है कि इस बार भी वही पुराना drama दोहराया जाएगा - @IncomeTaxIndia वाले शायद गुजरात हाई कोर्ट के आदेश के अनुसार Tax Audit और ITR Filing की एक महीने की Extension का नोटिफिकेशन 31st October की शाम को ही जारी करेंगे।

इनकी तो सालों से यही “अंतिम समय पर राहत” वाली आदत है - चाहे GST की due date हो या Income Tax की, हमेशा taxpayers और professionals का खून चूस-चूस के ही आख़िर में Notification निकालते हैं।

पूरे महीने tension में रखो, सिस्टम पर दबाव डालो, professionals को परेशान करो और फिर आख़िर में बड़ी मेहरबानी दिखाते हुए “Extension Granted” का नोटिफिकेशन जारी कर दो।

Tax compliance अब deadline से ज़्यादा patience की परीक्षा बन चुकी है! 😢
