My friends at Bar and Bench seem to have misunderstood the Court.

Let me clarify - this headline/description is wrong. There is absolutely no “allowance” for a mix of Central and State government officers as is claimed in the news report.

The Hon’ble Judge clearly stated that the election commission would be well within jurisdiction to choose from only one pool - centre or state - and therefore there is no binding requirement to pick a mix from both. This is as per the law as it stands, nothing more. Plain reading of the text, as lawyers put it.

Simply stated - the TMC has lost yet again in the Supreme Court and their insistence on having state government employees has zero basis in law. The interpretation of the Hon’ble Judges is spot on.

Huge setback for TMC.
