Legal Questions on the FIR Against @ajeetbharti :-

The FIR reportedly invokes the SC/ST (Prevention of Atrocities) Act over statements allegedly concerning members of the SC community.

But the real legal questions are:

Does the FIR identify a specific SC/ST victim against whom the alleged caste-based insult was directed?
Does the alleged statement disclose intentional insult or intimidation on the ground of caste?

Are the essential ingredients of Sections 3(1)(r)/(s) specifically made out from the FIR itself?

If the complainant is a third party, does the FIR establish how he personally falls within the ingredients of the alleged offence?

A third party can certainly provide information about a cognizable offence. But the mere fact that a complainant belongs to an SC/ST community does not automatically establish an offence under the SC/ST Act.

The statutory ingredients must be independently satisfied.

Law cannot be invoked merely by attaching a serious statute to an allegation. The ingredients of the offence must speak for themselves.

Here’s the real status of GPS Basti Hazoor Singh, Fazilka: we get our school buildings checked regularly, and a special review was done after the 2025 floods. In that exercise, 3 rooms were found unfit and declared unsafe on 08.12.2025. Dismantling was ordered immediately.

Class 4 & 5 students shifted to a school within 1 km. Pre-Primary to Class 3 students are studying safely in 2 classrooms in perfect condition — sharing photos of the same.

₹28.65 lakh sanctioned for 3 new classrooms in this year’s Financial Planning, work also commencing this week.

As I informed in my status report on Punjab schools a few days ago, this school falls in the category of the 500 schools being completely redeveloped, and will be ready soon.

P.S - Just to remind you Punjab saw the worst ever floods in 2025, 7000+ of our schools got damaged. After repeated requests and reminders, no aid came from the Centre for Punjab. Only vague announcements.
