$NBIS: Three lawsuits in Birmingham, AL just got consolidated into one, and two new ones landed. Construction keeps going 6 days a week, 12 hours a day.

Quick recap: on August 12, Judge Crayton set a non-jury trial for March 8, 2027, and denied the preliminary injunction. So construction has continued as usual (see the drone footage I posted a couple days ago).

At the time, three lawsuits were in play (more details in quoted post chain):

- Robert and Gail Sansome, an Oxmoor Valley couple living less than half a mile from the site

- A second one on behalf of other nearby residents

- One from the Greater Birmingham Humane Society

Same defendants, same core facts and legal questions, so the judge consolidated them to rule on the common issues together. Next hearing: still March 8.

Now, two new lawsuits have joined the pile:

- A Regions Financial shareholder is suing over the land sale. Regions used to own the main parcel that's now the Nebius site. The suit claims two same-day resales inflated its price by $66M, and that Regions executives failed to get fair market value while Nebius and its partners hid a pre-arranged flip deal. It seeks that $66M back, plus damages.

- A Birmingham resident is challenging the $3.2B, 30-year tax break, alleging the Industrial Development Board rushed it through an improperly-noticed May meeting (right before new state limits on such incentives kicked in) without the required cost-benefit analysis. She wants the deal voided.
