Brittany Murphy’s death was attributed to severe pneumonia, which occurred two hours after someone mysteriously entered her room. Her husband died the same way . Prodigy’s death was caused by choking on an egg that mysteriously entered his room. James Brown’s death was attributed to pneumonia, which was also allegedly caused by someone entering his room. It’s hard to make sense of these events.
Officer intimidation fail. Ego crumbling in real time.
San Antonio, Texas, driver Janet Spradley spotted a motorist swerving erratically across the road. Suspecting a drunk driver, she did what any responsible citizen would do—she dialed 911, guided patrol units toward the vehicle, and made sure officers could safely take over the pursuit.
Before hanging up, Spradley made one thing crystal clear to dispatch: she was reporting the hazard as a concerned motorist, but did not want her name attached to police reports or to give a formal statement.
Once officers located the suspect vehicle, Spradley pulled off the road, directed another approaching patrol car toward the driver, and headed to a nearby gas station to carry on with her night.
That is where San Antonio Police Department Officer Gibson confronted her.
Instead of a simple "thank you for the call," Officer Gibson cornered Spradley outside the store and demanded her official witness statement and government ID.
When Spradley reiterated that she was exercising her right to stay out of the formal investigation, the officer pulled out a copy of Texas Penal Code § 38.02 (Failure to Identify) and began reading the statute to her, claiming she was legally mandated to hand over her information as a witness to a crime.
There was just one major problem: Officer Gibson’s interpretation of Texas law was completely wrong.
Under Texas Penal Code § 38.02, citizens are only required to identify themselves to law enforcement if they have been lawfully placed under arrest. A witness is not a suspect, has not committed a criminal offense, and is under zero legal obligation to surrender identification or give a statement at the scene.
Spradley stood her ground, invoked her Fifth Amendment protections, and demanded a supervisor. Recognizing that his intimidation tactics had hit a legal wall against an informed citizen, the officer was forced to terminate the stop and allow her to leave freely without an arrest or citation.
Know your rights, understand your local statutes, and never let intimidation override constitutional law.
