From November 2025 India changed gratuity rules for millions of salaried employees.
Most people do not know this yet.
Here is what changed and how much more money you are now legally owed.
Old rule. Your company calculated gratuity on basic salary only. They kept basic salary at 25 to 35 percent of your CTC deliberately to reduce what they owed you.
New rule. Basic salary must be at least 50 percent of your CTC. This directly increases the base on which your gratuity is calculated.
The formula stays the same.
Gratuity = Last drawn basic salary x 15 divided by 26 x years of service.
But because basic salary is now higher the final number is significantly bigger.
Example. If your CTC is Rs 12 lakh and you have worked 7 years.
Old basic salary Rs 3.5 lakh. Gratuity = Rs 2.02 lakh.
New basic salary Rs 6 lakh. Gratuity = Rs 3.46 lakh.
That is Rs 1.44 lakh more. Just because the rule changed.
One more thing most people miss.
If you are a fixed term employee and you have worked for at least 1 year you are now eligible for gratuity. Earlier you needed 5 years.
Your employer knows this. They are counting on the fact that you do not.
Follow for one thing every salaried Indian must know before it costs them money.
