#WATCH | Delhi | On the now-withdrawn Bar Council of India's decision regarding NALSAR students, Senior Advocate Vikas Singh says, "... As a regulator, he should have first examined whether he could pass such an order... There is no such provision in the Bar Council of India that gives the Chairman any power to pass a sweeping order that a particular batch will not be enrolled. So the order was completely illegal... When he withdrew that order, he did not do a full withdrawal... Then he realised that he may face another setback or rude rebuff. So he tweets at midnight that he's withdrawing the order completely. This means that he's running the BCI as his personal property. He feels that he's above the law... It needs to be debated whether a person like this can continue... What the students did was also not in good taste... Because the Chief Justice of India is the head of the entire judicial family, to say that we will not take degrees from him is not proper... There are better ways for them to protest..."

जज़,जूता,आरटीआई और मैं …

मैं फरियादी के रूप में अदालत में खड़ा था — उम्मीद थी न्याय मिलेगा, मगर मिला अपमान।
महिला जज का व्यवहार ऐसा जैसे मैं कोई अपराधी हूँ। बदतमीज़ लहजा,सख्त चेहरा ,आँखों में सभी के लिए तिरस्कार।कक्ष में उपस्थित सभी उसका ये घमंडी व्यवहार सहते रहे पर मेरी उस दिन महिला जज से उसके व्यवहार को लेकर बहस हो गई,मेरे वकील ने मामला शांत कराया।

बाहर निकला तो दरवाज़े के ऊपर एक नोटिस चस्पा दिखा —
“जूते-चप्पल बाहर उतारकर ही प्रवेश करें।”
क्षणभर को ठिठक गया… ये मंदिर है या अदालत? पर मैं ये भी समझ गया था की कोई व्यक्ति/अपराधी इस जज के ऊपर जूता ना फेंक दे इसलिए उसने यह नोटिस चस्पा करवाया है।

दूसरे ही दिन मैंने DJ ऑफिस में जनसूचना अधिकारी को 10/-₹ का पोस्टल आर्डर लगा के RTI दायर की —

“उक्त जज के कमरे के बाहर जिन नियमों के तहत जूते-चप्पल उतारने का आदेश/ नियम चस्पा है,उसकी सत्यापित छायाप्रति उपलब्ध करायें”

बस, इतना RTI लगाना था कि हलचल मच गई।

तीसरे दिन मेरे वकील का फोन आया —

“भैया, मैडम ने आपको सॉरी बोला है… RTI ज़रा वापस ले लीजिए।”

(वैसे आरटीआई वापस लिए जाने का कोई प्रावधान नहीं है)

मैं मुस्करा पड़ा —

“जब सच्चाई से सवाल पूछा जाए, तो माफ़ी ही जवाब बन जाती है।”

कभी-कभी अदालत में हथौड़े की नहीं, कलम की खनक भी गूँज जाती है। ✍️⚖️
