🇮🇳 Can the RBI ban crypto in India?

Not on its own.

And that distinction matters.

On July 2, the RBI reiterated before Parliament:

→ VDAs should not be legitimized
→ The absence of a formal policy can itself be a policy choice
→ Its position has remained broadly consistent since 2013

But India’s legal framework has moved in a different direction:

↳ Finance Act 2022 — VDAs formally defined under tax law
↳ Section 115BBH — 30% tax on VDA income
↳ Section 194S — 1% TDS on VDA transfers
↳ FIU-IND — AML compliance framework for VDA service providers

This creates an important distinction:

Taxation ≠ legalization.
Regulation ≠ endorsement.
And an RBI position ≠ a Parliamentary ban.

In 2018, the RBI restricted regulated entities from servicing crypto businesses.

In 2020, the Supreme Court set that circular aside.

Today, the RBI can recommend, caution and shape policy within its mandate.

But an outright nationwide prohibition would require legislative action.

Meanwhile:

119M users.
Chainalysis No. 1 for 3 years.
A functioning tax framework.
An AML compliance regime.

The contradiction is obvious:

One institution warns against legitimization.
Another collects taxes.
Another enforces compliance.

India doesn’t lack crypto activity.

It lacks policy coherence.

So the real question isn’t simply “ban or regulate?”

It’s how long India can sustain regulatory ambiguity at this scale.
