A Nairobi woman is taking Safaricom to court after KSh 2,700 she accidentally sent via M-Pesa was used to clear the recipient’s #Fuliza debt and her reversal request was rejected.
Here’s the issue: when you send money, your intent is to pay a person, not to settle their loans, not to guarantee their debt, and not to enter any hidden agreement with a telecom.
So how does your money get redirected to repay someone else’s overdraft without your consent?
If we normalize this, we risk allowing silent policies to shift financial burdens onto innocent third parties. Convenience should never override fairness or basic property rights.
Yes, the recipient agreed to Fuliza terms, but the sender didn’t. That’s the concern!
At minimum, there should be transparency:
“Recipient has an outstanding Fuliza balance. Funds may be used to offset debt. Proceed?”
This isn’t about KSh 2,700. It’s about how far automated financial systems can go before crossing the line on consumer rights.
