A federal judge fined a Texas lawyer $2,000, made him take a class on AI, and made him hand the sanctions order to his own client.
All because his AI-drafted brief cited two cases that don't exist.
Texas doesn't have one clean AI rule for attorneys, it's a stack...
-State Bar Ethics Opinion 705 (verify everything, don't bill for time "saved")
-A patchwork of federal judges each with their own AI disclosure rules
-TRAIGA, a bigger law governing what your AI vendor can do with your data
Florida just standardized its AI disclosure rules for attorneys โ and it was a long time coming.
On May 28, 2026, the Florida Supreme Court amended Rule 2.515(d)(2). It took effect June 15. The catalyst? AI-generated hallucinations creeping into court filings.
Fabricated citations, invented quotations, nonexistent holdings that read as convincing as the real thing. Courts across the state were already diverging on how to handle it. The Supreme Court stepped in before the patchwork became permanent.
โI think that the real risk isnโt AI replacing defense attorneys. I think the risk is a defense lawyer without these tools will probably miss the exculpatory moment thatโs sitting in their own discovery,โ
