"A bipartisan group of U.S. senators has refiled legislation (Senate Bill 4942) to protect banks, credit unions and other financial institutions that provide services to state-legal marijuana businesses.
The Secure and Fair Enforcement Banking Act, commonly known as the SAFE Banking Act, was filed by U.S. Senator Jeff Merkley (D-OR) and is cosponsored by Senators Lisa Murkowski (R-AK), Steve Daines (R-MT) and Elizabeth Warren (D-MA).
The measure is designed to address one of the marijuana industryโs most persistent challenges: limited access to traditional financial services due to the ongoing conflict between state legalization laws and federal prohibition. Although dozens of states have legalized marijuana for medical or recreational use, many banks remain reluctant to work with licensed businesses because marijuana remains federally illegal."

Some food for thought: Schedule I has two cumulative predicates: high abuse potential and no currently accepted medical use. The moment you assert "medical marijuana belongs in Schedule III," you've conceded the substance has a CAMU. But CAMU is a property of the substance, not of a transaction. And once the substance has a CAMU, the Schedule I predicate is destroyed for the entire substance โ there's no "recreational marijuana" molecule left over that lacks a CAMU, because it's the identical molecule. You'd be asserting that marijuana simultaneously has a CAMU (to justify the III track) and has no CAMU (to justify stranding rec in I). That's not a hard argument to win; it's a logical contradiction the statute won't hold. So use-based bifurcation isn't just unprecedented โ it's internally incoherent under ยง 812.
