The assistant testified via deposition but her side didn't play it for the jury.
The judge refused to allow the texts because they were hearsay and non credible, and these are the same texts about the kicking claim.

And she could've waited for the verdict to be voided and a new trial ordered, then settle.
If she had hope for either, she would've waited. She filed it for a reason.
