BREAKING: YES! A federal appeals court deals Trump a crushing Friday defeat by ruling that his hack MAGA minion John Sarcone was “not lawfully serving” as New York's top federal prosecutor when he targeted Letitia James’ office.

This will send him into the weekend steaming mad...

“We hold that Sarcone was not serving as Acting U.S. Attorney when he obtained the subpoenas because the [Federal Vacancies Reform Act] permits only a First Assistant already in place when the vacancy arises to become the acting officer automatically,” Judge Guido Calabresi wrote in a 39-page opinion, using an abbreviation for the 2nd U.S. Circuit Court of Appeals.

The court's ruling upholds a January decision from a lower court which disqualified Sarcone as the acting U.S. attorney for the Northern District of New York and quashed the subpoena he issued to James's office as part of a blatant White House-backed campaign of political retribution.

Trump has been trying to exploit an automatic succession rule loophole to appoint his henchman as top federal prosecutors by making them "first assistants" which is technically the number two position inside a U.S. attorneys office. He hoped that with the top job vacant, the No. 2 appointee would become the de facto U.S. attorney.

In Sarcone's case, his 120-day term as interim U.S. attorney expired last July, at which point then-Attorney General Pam Bondi mutated his title to "special attorney," hoping to keep him in place.

“To install someone in a vacant office through a general delegation authority that [federal statute] expressly forbids, is to install an acting officer by another name,” Calabresi wrote. “The FVRA forbids it.”

The Justice Department has already signaled that they intend to pursue this case to the Supreme Court, where they hope that the corrupt MAGA justices will side with their abuse of power. But this case is such an open-and-shut issue that even the most crooked judges on the bench may have to side against Trump.
