The AU Protocol on Free Movement of Persons, adopted in 2018 alongside the AfCFTA, was envisioned as a cornerstone of continental integration, granting Africans the Right of Entry for visa‑free short visits, the Right of Residence to live in another member state, and the Right of Establishment to work and create businesses across Africa.
However, despite its promise, ratification has been slow, with only a limited number of states endorsing it by mid‑2026, leaving implementation fragmented. This uneven progress cannot be attributed to any single country, as the challenges stem from collective hesitancy among member states, shaped by economic pressures, security concerns, and national priorities.
The responsibility lies with all AU member states to advance ratification and implementation
of AU Protocol on Free Movement of Persons. Furthermore, South Africa, cannot be expected to serve as the continent’s hub for illegal immigration. It is time for citizens across Africa to hold their governments accountable, just as South Africans are doing by demanding that their government fully implement immigration laws.
