Nahal Oz: An Illegal Settlement on Occupied Land

Nahal Oz, where Levy was stationed, is an Israeli settlement built on occupied Palestinian territory, a point that international law and numerous United Nations resolutions repeatedly highlight. Under international law, Israeli settlements in the occupied West Bank, East Jerusalem, and parts of Gaza are considered illegal. The Geneva Conventions explicitly prohibit an occupying power from transferring its own civilian population into the territory it occupies, making the establishment of settlements like Nahal Oz a violation of international law.

As a member of the IDF, Naama Levy was directly serving in a military capacity that contributes to the maintenance and expansion of Israeli control over Palestinian land. The role of the IDF in these territories is integral to Israel’s occupation, enforcing policies that limit Palestinian rights, movement, and sovereignty.

Prisoner of War or Occupation Force?

Levy’s capture by Hamas, a group recognized as a terrorist organization by many international bodies, would classify her as a prisoner of war (POW) under the laws of armed conflict. POW status is typically granted to military personnel captured during active combat. However, the broader context of Israel’s occupation of Palestinian lands complicates this narrative. Levy, as an IDF soldier stationed in an illegal settlement, can also be viewed as part of a military force enforcing an occupation, which itself is a violation of Palestinian sovereignty and rights under international law.

From this perspective, while Levy may be considered a POW under international law, her role in an occupying force raises ethical questions about her presence in Palestinian territory.

The Path to Peace: Ending the Occupation

The only sustainable solution to ensure the safety and return of Israeli soldiers like Naama Levy, as well as the security of both Israelis and Palestinians, lies in addressing the root cause of the conflict: the occupation of Palestinian lands. For decades, Palestinians have faced the reality of living under occupation, with restricted freedom, the demolition of homes, and the expansion of illegal settlements.

Calls for Israel to withdraw from Gaza and return all occupied Palestinian territories to a free and independent Palestine have grown louder with each escalation of violence. Returning stolen lands and ending the occupation is seen by many as the only viable path to lasting peace in the region. This would not only prevent further military escalations but also address the deep-seated grievances that fuel the ongoing conflict.

Naama Levy is an IDF soldier serving in the capacity as an intelligence observer.

She was assigned to the Nahal Oz outpost when it was overrun by Hamas on October 7.

Nahal Oz is an illegal settlement built upon occupied Palestinian territory.

She is at best a prisoner of war. But she is also part of an illegal occupation force.
