Joe Biden now says they won't enforce the TikTok ban on January 19

They are leaving it up to Donald Trump to figure it out

"Our position on this has been clear: TikTok should continue to operate under American ownership ... it will be up to the next administration to implement"

The law states the president can grant a one-time extension delaying the ban for up to 90 days under three specific conditions

1️⃣ TikTok must show it's on a 'path to executing' a divesture from its Chinese owner, ByteDance

2️⃣ There must be 'evidence of significant progress' toward a sale

3️⃣ Must be sealed with 'relevant binding legal agreements'

Meanwhile, the Justice Department can impose fines of up to $5K per user on companies like Google and Apple if they continue hosting the app after the ban takes effect
