The High Court could also strike down sections of the SDA and/or interpret the provisions differently, creating new law.

@paulbentleymelb @jaycee0202 @tonytardio If someone is on multiple counts of bail, then that is a prima face case that the person will not (because they have demonstrated that they won’t) comply with bail conditions. In that case, bail refused, into custody they go.

@jaycee0202 @tonytardio It doesn’t matter. The fact that people are on bail and still offending, regardless of what the offending is, shows that the system is not working.

The “community protection” element of the bail test is not working if people are reoffending.
