You had announced on the floor of Parliament that, during the pendency of an appeal before the Commissioner (Appeals), an assessee would be required to deposit only 10% of the disputed tax demand, as against the earlier benchmark of 20%. However, the announcement is yet to be implemented through an amendment, circular or binding administrative instruction.
I now understand the possible difficulty. You may have been advised that if a circular reducing the requirement to 10% is issued at this stage, the Department could be required to refund the excess 10% already recovered in all cases where appeals are still pending. That concern may not be entirely unfounded.
A fair solution would be to direct the Department to identify all cases in which 20% of the disputed demand has already been recovered while the appeal remains pending before the Commissioner (Appeals), and prescribe a definite timeframe within which such appeals must be taken up on priority and disposed of. Where the Department continues to retain substantial tax without even a first appellate order, elementary fairness requires that the appeal be heard expeditiously.
Your announcement reducing the deposit requirement to 10% was fair, just and equitable—particularly when appeals before the Commissioner (Appeals) are frequently taking more than five years to be decided.
Pending issuance of a formal circular or amendment, the Departmental heads may at least be administratively advised to ordinarily grant stay upon deposit of 10% of the disputed demand, especially where the assessee demonstrates a reasonable prima facie case.
Urgent steps are necessary to ensure that an assurance given on the floor of Parliament is implemented in letter and spirit and retains its credibility.

@IncomeTaxIndia when will there be a situation when after the appeal is won by the assessee, he gets a refund due to him along with interest within three months as stipulated by the Act. I haven’t come across a single case in recent times, when one hadn’t had to struggle, write numerous letters, meet the concerned officers to be able to get a refund. Now the CPC has become a black hole where after the AO’s recommendation, it takes forever for the refund to be generated. Please look at this procedural infraction which has become an epidemic.

battle before the Tribunal, though the AO found an amount of

but has still not remitted the amount…….’

After depositing 10% of the basic demand as against the earlier circular requiring deposit of 20% (which was being collected on total demand incl interest as the circular is not clear).. this has not been implemented as of date which is more than 5 months after the speech

@KiaInd I have a Kia EV6. The car is wonderful, but the service I get at the workshop at Jayanti Kia India is bothersome.
The front seat movement of the car has spoiled because of some part which has gone out of order. On 28 June, the car went to the workshop, and they said they don't have the part and will have to import it. Now we are only almost a month away, and I haven't heard from them yet. The unfortunate part is that they don't revert. At least one gets the assurance that something is being done.
Also, I can't understand why the parts have always to be sourced from outside. This is a big dampener for sales of the EV6. This is the second time it's happening that the parts have to be brought in from abroad. Last time, it was the steering which had started to make noise, and I had to wait for more than a month to get it replaced.
Needless to add that I have a 5-year warranty, but I am disappointed with the service. Kindly intimate the concerned at Kia Jayanti to become more serious about these matters.
Just trying to get it amplified.. am sending/tagging the journalists covering finance ministry beat.. it will be a great relief to tax payers across the country..
Respected @nsitharaman ji, you had in your speech on the floor of the parliament made a statement that 10% would be the tax deposit in respect of matters where the first appeal is pending before the Commissioner (Appeal). However, the statement has not resulted in any notification or a circular from the Income-tax Department. Not only does this affect the sanctity of the Parliament but also your commitment to the tax-paying public, which should be paramount. @IncomeTaxIndia@narendramodi
