On December 15, 1836, a fire tore through the Patent Office burning it to the ground. Inside the building, the nation’s first 46 years of recorded intellectual property went up in smoke. The 9,000+ patents lost in the ashes are now known as the X-patents.

@eric_shanks You could ask an attorney to send a Cease and Desist letter based on your common-law rights to the design. Hiring an attorney would send the message that you are serious about defending your rights. You could also consider filing a TM application to deter future infringements.
