They had other ways to handle it. Like forcing it to arbitration which would have been legally binding. And your comment about the biggest raise in 20 years is a bit misleading. When you say it as a 12% raise over 14 years it doesn’t sound great.

I don’t believe the notwithstanding clause should exist.
