South African Parliament is considering a bill that will attack free speech, freedom of religion, and enable arbitrary and vindictive prosecution for a brand-new expanded definition of “hate speech.”

The Prevention and Combating of Hate Crimes and Hate Speech Bill [B9B – 2018], is dangerous and unnecessary and MUST BE STOPPED!

B9B - 2018 is so over board and vaguely written that people can be prosecuted and put in prison for 8 years for an act they never even knew was a crime.
YOU CAN MAKE A DIFFERENCE
•Clause 1 fails to even define “hatred” which is the most essential part of the crime.
◦Leading to arbitrary prosecutions of citizens for simply hurting someone’s feelings. 
◦Resulting in prosecutions that violate Chapter 2 section 16 clause 1 of the South African Constitution guaranteeing the right to freedom of expression.
•Clause 4 establishes the crime of “hate speech” but never the legal definition. 
◦Clause 4(2)(d) contains a “religious exemption clause” that is so weak that it is truly no protection at all.
◦even the tenants of someone’s faith could be accused of being “hate speech” making freedom of worship in South Africa a crime. 
◦grossly violating Chapter 2 section 15 clause 1 of the South African Constitution, the guarantee to the right of freedom of thought, belief, and opinion. 
•If passed, this new and vague definition of “hate speech” as applied will
◦violate the protections of Equality established in the South African Constitution, Chapter 2 section 9 clauses 1-3
◦establish a subjective standard that some people’s rights are more valuable than others.
B9B – 2018 is an attack on speech, thought, opinions, faith, and the Constitution of South Africa.
