@CNviolations However the motorist will probably be at fault due to the pedestrian laws in cali. But it could be fought due to negligence of the cyclist.

@CNviolations Hate to say it but the cyclist should’ve been riding in the traffic lane rather than on the sidewalk. In which case the driver technically would’ve had to treated the cyclist as a vehicle and probably would’ve had to wait for the cyclist to pass the driveway before turning in.
