The man charged with assaulting a Rochester NY police officer on Monday is an illegal alien who had a standing deportation order against him.

Elio-Enrique Auzate-Hasma, 33, also had a state warrant for his arrest on a charge of aggravated assault.

Police were called after the Venezuelan national in this country illegally allegedly violently assaulted someone in his home.

In a scuffle as Auzate-Hasma resisted arrest, an officer sustained an injury that has put him out of work.

Auzate-Hasma had been arrested previously for the aggravated assault, but -- Rochester being a sanctuary city -- police were forbidden to notify federal immigration officials. DHS officials did not know that this man, with a deportation order, had been arrested.

And so he was free in the city, and allegedly committed these violent felonies.

@GovKathyHochul is advocating for a state law that would forbid New York law enforcement agencies from cooperating with federal immigration officials.
