Part of the reasons that led to the strike embarked by PENGASSAN is Dangote’s decision to sack over 800 employees who indicated interest in becoming a member of the union. As a legal practitioner, i feel the need to state my opinion on this subject.

On the other hand, where there is no agreement prohibiting any employee to unionise, then the decision of Dangote Refinery to sack them will be unconstitutional as it will amount to an infringement of their fundamental human right to freedom of association or assembly.

will amount to a breach of contract. In this case, the decision of Dangote to sack his employees would have been justified. Because it is easy to decipher that joining any union would definitely attract disciplinary action.

The first issue to consider will stem from the contract of employment that binds Dangote refinery and his employees. If it can be shown that there is an express stipulation which prohibits any employee from joining any association or union, the employees act of joining any union
