The position of law as per the Finance Bill, 2024 is however pretty straight forward. All LTCG arising from transfers taking place *after* 23 July 2024 is to be taxed at 12.5%. Period.

There is NO idexation benefit available to properties purchased prior to 2001. However, FMV is indexed cost of acquisition. Thus, only to that extent indexation benefit is available. Post 2001, any appreciation on such property will be LTCG taxed at 12.5%.

Senior Advocates who have already enjoyed the privileges that come with their designation have no locus standi to challenge the constitutionality of Section 16(2) of Advocates Act. In case a larger bench is set up to review the matter, "other advocates" views must be considered.
