@JoeFreshest If most of the episode is visible and viewers can follow it through your reaction, that's much harder to defend as fair use.

Fair use is more like using occasional clips or images to support your own commentary, not the other way around.

But yeah, just my opinion… Good luck :/

@JaymesHanson @imcoco_0 @VIZMedia @TeamYouTube I'd also add that the subtitles are perfectly visible, and they're copyrighted too. You just don't see copyright claims over subtitles very often.

@JoeFreshest Still images are much easier to defend as "fair use" in a Copyright claim.

When 70/80% of the full episode (video) is being shown... not so much.

And bypassing YouTube's copyright detection to keep it monetized, plus the Patreon stuff, certainly makes the intent look worse.

So yeah, my advice would be: go legal, keep what you've made so far, and move toward a more "copyright-safe" format like analysis and episode breakdowns.

Adding an overlay over a copyrighted video doesn't make it less copyrighted content. It's also a behavior that likely goes against Youtube's ToS since I guess they didn't place a Copyright detection process on uploads for nothing.

@yumichyun1 @AnimeTokki I have no idea, but they're showing most of the episode with commentary on the side, so it's pretty safe to assume it's likely copyright infringement.

They also edit aroundwith overlays and by removing music, which doesn’t necessarily make the use compliant with YouTube's ToS.
