Sharmistha’s Arrest and the Perils of Free Speech in India

Last night, Sharmistha, a fourth-year law student from Pune’s Symbiosis Institute, was arrested by Kolkata police in Delhi without prior notice for alleged hate speech against the founder of Islam.

Her crime? Responding with frustration, admittedly with foul language, to a Pakistani troll questioning India’s Operation Sindoor. Despite deleting her video and issuing a public apology, Sharmistha now faces the wrath of a system that seems to prioritise mob outrage over fairness.

What is Section 295A? This colonial-era law, enacted in 1927 after the Rangila Rasool case, criminalises “deliberate and malicious acts” intended to outrage religious feelings, with up to three years imprisonment. It’s often invoked alongside Section 153A (promoting enmity) and Section 505 (public mischief), but its vague wording makes it a tool for silencing dissent, from political satire to social media posts. The Supreme Court has clarified that only acts with malicious intent disrupting public order should apply, yet arrests like Sharmistha’s show its misuse.

We’ve seen this before. Nupur Sharma, a BJP spokesperson, faced global backlash and death threats for comments on the Prophet, amplified by influencers like Zubair, who weaponised social media to fuel outrage. Yati Narsinghanand, charged for hate speech, was targeted under the same laws, with his case escalating after viral clips sparked mob demands. Both faced severe consequences, careers derailed, lives threatened, showing how it can be a blunt instrument against free speech.

Sharmistha’s case is even more alarming. A young student, she apologised for her remarks, yet faced relentless death and rape threats, with #ArrestSharmishta trending on X. AIMIM’s Waris Pathan publicly demanded action, inciting a “sar tan se juda” mob that pressured her arrest.

Unlike high-profile figures, Sharmistha lacks the resources to fight back. Her late-night detention without notice raises questions about due process and selective enforcement.

Sharmishta, a 22-year-old Hindu woman with a bright future, has been arrested. Not for committing a crime. Not for violence. But for telling the truth and refusing to bow to Pakistan’s ideological intimidation campaign.

This is not justice. It’s the enforcement of blasphemy law, disguised as legality, under pressure from Pakistan’s radical machine and its enablers within India.

Her arrest isn’t a victory for law and order.
It’s a victory for Pakistan.

🔴 SHARMISHTA’S “CRIME”

It began when Sharmishta called out a Pakistani woman spreading false claims that India had started a war - deliberately ignoring Pakistan’s blood-soaked history of terrorism, including the Pahalgam massacre, where innocent Hindus were slaughtered.

Sharmishta stood her ground.
She defended the truth.
She refused to be silenced.

That was all it took.

Islamic outrage mobs exploded - furious that a young Hindu woman dared to challenge their narrative.
Under Islamic law, that’s unacceptable. A woman—especially a non-Muslim - has no right to challenge male authority.

So they came for her:

🔻 Waris Pathan, the AIMIM spokesperson, rushed to file a complaint.
🔻 Mohammad Shadab Khan, another radical voice, joined in.
🔻 The digital jihadis of Team Rising Falcon demanded her arrest like obedient blasphemy enforcers.

And the Indian state - bowing under pressure - delivered.

🚨 THIS IS A GLOBAL WARNING

Let’s be clear: Pakistan just enforced its blasphemy code inside a Hindu-majority democracy. And it worked.

Where is the outrage?

Where are the women’s rights organizations now?

Where are the human rights groups and free speech defenders?

Why are they all silent while a peaceful young woman is arrested for simply telling the truth?

While the West grovels to “tolerance,” Pakistan continues exporting its terrorism, ideology, and Sharia demands across the globe.

And now, it’s hunting the innocent - with the Indian governments' help or silence.

🔴 I STAND WITH SHARMISHTA. AND I STAND AGAINST THIS MACHINE.

💥 I will NOT let the world pretend this didn’t happen.
💥 I will NOT stay quiet while a terror state like Pakistan destroys lives - with the West’s approval.
💥 I will NOT stop until Sharmishta is free, and every coward doing Pakistan’s bidding is exposed.

This is no longer about one woman.
This is about whether we still live in a world where truth has a right to exist.

Where was the U.S. when India had Pakistan backed into a corner?

Where was the support when India needed the go-ahead to dismantle a terror state once and for all?

Instead of encouraging India to finish the job, the United States caved to “diplomacy” and “optics” - empowering Pakistan to continue its global war of subversion.

And the result?

Pakistan now wages ideological jihad across America:

Controlling radical mosques protected by tax exemptions

Embedding operatives in politics, law enforcement, and schools

Shaping public discourse with “Islamophobia” propaganda

Even securing Pakistan Day celebrations inside NYPD headquarters - in the very city devastated by bin Laden
Texas has a Pakistan Day, too

This isn’t foreign policy. It’s national suicide.

Pakistan has its tentacles deep inside the West—conquering a piece of every country it enters.

And the U.S. government? It’s not resisting.
It’s enabling.
