Call the McAlbert’s Bluff:

Attorneys Chris Mattei and James Tuxbury are blanketing content creators, both in Massachusetts and out of state with 3rd party preservation letters and subpoenas over their Karen Read and Turtleboy defamation lawsuit.

If you got one, don’t panic. Call their bluff.

Here is the legal reality whether you live in MA or across the country:
🛑 It’s a freeze, not a seizure. A preservation letter just means "turn off auto delete." It does NOT mean you have to hand over your phone, emails, or hard drives right now.
🛑 You hold the cards. Under civil rules, non parties can serve a simple written objection to a document subpoena without spending thousands on a lawyer.
🛑 The burden shifts to them. Once you serve your objection (usually required within 10–14 days), the process stops. They cannot just demand the data again.

If you’re out of state:
To override your objection, Mattei and Tuxbury have to travel to YOUR state, hire local counsel, pay local filing fees, and convince your local judge.

If you’re in Massachusetts: They still have to draft a formal Motion to Compel, go to a judge, and fight your objection in court.

Even better? Whether you are in MA or elsewhere, the courts strongly protect 3rd parties from "significant expense." If a judge actually orders the data extraction, the requesting attorneys are usually the ones forced to pay the massive digital forensic bills, not the creator.

It’s an expensive fishing expedition designed to intimidate creators who covered the trial. Turn off auto delete, serve your written objection, and watch them walk away when they realize you know exactly how much time and money it will cost them to fight you. 💸

This is why Melanie Little will never be served a subpoena.

@PlantationDad @hell_line0 I don’t know the answer to your question regarding democratic or republican DA’s prosecuting sex crimes, but surely all sex crimes should be prosecuted to the fullest extent of the law regardless of your political affiliation or who you know. This is a travesty!
