Det er vigtigt at værne om både demokratiet og retsstaten, netop derfor er det rigtigt, at domstolene ikke åbner op for, at civilsamfundsorganisationer uden direkte retlig interesse kan føre sager om dansk våbeneksport.

At NGO’er har medarbejdere i Gaza, og dermed føler sig berørt af konflikten, betyder ikke, at de automatisk skal have adgang til at få prøvet statens udenrigspolitiske beslutninger ved retten. Retsstaten bygger på klare juridiske principper, ikke på følelsesmæssig eller politisk tilknytning. Hvis vi først begynder at slække på kravet om retlig interesse, risikerer vi, at domstolene bliver et forum for politiske slagsmål, snarere end en uafhængig juridisk instans.

Danmark har en legitim ret til at føre sin egen udenrigs- og sikkerhedspolitik, inklusive eksportpolitik, og det er Folketinget, ikke NGO’er eller domstolene, der har ansvaret for at fastlægge den linje. Når man kræver, at domstolene skal kontrollere og i praksis kunne underkende eksportbeslutninger, fordi nogen kan tænkes at blive påvirket af dem indirekte, så svækker man både princippet om adskillelse mellem magtens grene og Danmarks politiske suverænitet.

Man kan sagtens være kritisk over for eksporten af våbendele til Israel, det er et legitimt politisk standpunkt, men kampen bør tages der, hvor den hører hjemme: i det politiske rum, ikke i retssalene.

Skal vi virkelig lade dansk våbenpolitik styres af udenlandske konflikter og følelsesladede kampagner? Israel har ret til at forsvare sig, og Danmark har ret til at handle med sine allierede. Hvis man vil ændre dansk eksportpolitik, så må man gøre det gennem Folketinget, ikke gennem domstole, presset af aktivistgrupper med en klar politisk agenda.

Det her handler ikke om retssikkerhed. Det handler om at nogle vil bruge domstolene til at gennemtvinge en ensidig, politisk korrekt dagsorden. Tak til Landsretten for at sige fra.
