İstanbul Valiliği, 07–10 Eylül tarihleri arasında Beşiktaş, Beyoğlu, Eyüpsultan, Kağıthane, Sarıyer, Şişli ilçelerinde her türlü toplantı, gösteri, basın açıklaması ve etkinliği yasaklamış; aynı zamanda CHP İstanbul İl Başkanlığı polis ablukasına alınmıştır. Bu uygulama, yalnızca demokratik siyaseti değil, doğrudan halkın iradesini hedef almaktadır.

Toplantı ve gösteri hakkı, Anayasa’nın 34. maddesinde ve Türkiye’nin taraf olduğu uluslararası sözleşmelerde devletin keyfine bırakılmamış, güvence altına alınmıştır. Valiliğin bu yasaklama kararı ve polis ablukası açıkça keyfi olup ve hem Türkiye'nin iç hukukuna hem de taraf olduğu uluslararası sözleşmelere aykırılık içermektedir.

Üstelik İstanbul Valisi Davut Gül, hukuksuz biçimde alınan bu kararları dayanak göstererek yurttaşları ve siyasal aktörleri cezai yaptırımlarla tehdit etmiştir. Bu tehditler, devletin görevinin yurttaşların haklarını güvence altına almak değil, onları baskılamak olduğu anlayışını açıkça ortaya koymaktadır.

Ablukaya karşı çıkan yurttaşların gözaltına alınmaya başlanması ise bu hukuksuzluğun en ağır tezahürüdür.
İnsan Hakları Derneği olarak altını çiziyoruz:
•Hiçbir idari makam, yurttaşların barışçıl toplantı ve gösteri hakkını toplu biçimde ortadan kaldıramaz.
•“Kamu düzeni” bahanesiyle dayatılan bu yasaklar, iktidarın muhalefeti susturma ve toplumu sindirme girişiminden başka bir şey değildir.
•Siyasal partilerin binalarının abluka altına alınması, demokratik hayatın kalbine indirilen bir darbedir.
•Valinin cezai yaptırım tehdidi ve gözaltı uygulamaları, halkın demokratik hak arayışını kriminalize etmeye yönelik kabul edilemez baskı politikasıdır.

İstanbul Valiliği’ne sesleniyoruz;
Bu hukuksuz yasaklar, tehditler, ablukalar ve gözaltılar derhal son bulmalı; yurttaşların ifade, toplantı ve örgütlenme haklarının önündeki engeller kaldırılmalıdır.

Gözaltına alınan herkes derhal serbest bırakılmalıdır.

İnsan hakları savunucuları olarak;

Baskılara karşı özgürlüğü, yasaklara karşı demokrasiyi, ablukalara ve gözaltılara karşı halkın iradesini savunmaya devam edeceğiz.
