BREAKING GOOD NEWS - LAND GRABS

The Supreme Court of Canada says Aboriginal title CAN’T be declared over private lands.

The high court refused to hear an appeal from the Wolastoqey Nation (NB) who sought to challenge the lower court of appeals decision to deny Aboriginal title over private property.

In 2022 that nation was granted Aboriginal title over a huge section of NB lands including private lands. The ruling also stated that Aboriginal title could be declared over private land EVEN IF a band wasn’t even trying to reclaim it.

That ruling was successfully appealed, and the nation tried hard to fight to get that power back but has failed.

This will have some impact on the appeal of BC’s Cowichan vs. Canada decision which described Aboriginal title as a “prior and senior interest” outside B.C.’s land title system and deemed portions of fee simple ownership “defective and invalid.”
