@nicolaosborne36 @ChopsyBristol@BristolCouncil The school can be named as parental preference but not solely on the grounds that there is a nearer suitable school, only if your choice of school is an inefficient use of resources. There are many cases where LA's incorrectly tell parents a school choice is parental preference.
Another case won! This time the LA were refusing to provide home to college transport to an adult learner due to the fact they had a Motability car. Sentas making a difference!
Another case won! This time for a post 16 student with SEND, the LA refused to provide transport as they lived within 3 miles of the college. Sentas making a difference!
Another successful Sentas appeal, this time the LA were refusing to provide transport on the grounds that the child was attending school on a part time timetable and they would only provide transport at the start and end of the school day. Sentas is having a good week!

LA: Parents can't have their school choice named on its own in section I of an EHCP as its an inefficient use of resources.
Sentas: Ok in that case what is the difference in total cost between parentsโ choice of school and the LA's choice of school?
LA: Don't know.
Two cases won this week, LA refusing home to school transport saying the school choice was "parental preference". In both cases the LA stated they were right, but they would provide transport as an "exceptional circumstance". Wish they'd admit fault, but right result in the end!
LA informed us case law we used in a home to school transport appeal doesn't count because it predates the Childrenโs & Families Act 2014.
Thanks for the information, but it still counts, also if you could follow the Act in the first place we wouldnโt be having this problem!
@icescream43@AspieDeLaZouch If it is a requirement for the safety of a child then the escort should be medically trained. As a rule the LA's will not specifically provide a medical escort unless its needed.

@andreaholmes23 Post 16 transport is complicated and there are many factors that come into play such as age of young person, their needs etc. Our rule of thumb is generally can the young person get to college by themselves? If not they could be entitled to some form of assistance
