지난 공지 이후에도 유튜브, 인스타그램, 틱톡, X(구 트위터) 등 글로벌 플랫폼을 중심으로 당사 아티스트를 악의적으로 비하하거나 성적으로 희롱하는 콘텐츠가 지속적으로 게시되고 있습니다. 특히 유튜브에서 자극적인 콘텐츠가 무분별하게 양산되며 아티스트에 대한 왜곡된 이미지가 빠르게 확산되고 있어 그 피해가 매우 심각한 상황입니다. 이에 당사는 약 3개월간 집중 채증을 진행하였고, 아티스트를 상습적으로 조롱·비방한 이른바 '사이버 렉카' 채널은 물론, 성희롱 및 인신공격성 쇼츠 영상이나 댓글을 게시한 계정까지 특정하여 증거 수집을 완료하였습니다.

당사는 법무법인(유한) 세종 및 미국 현지 로펌을 선임하여 위 계정들의 신원 확인을 위한 미국 법원 디스커버리(Discovery) 절차를 진행하고 있습니다. 아티스트를 대상으로 악의적인 게시물을 작성한 여러 X(구 트위터) 계정에 대해서도 동일한 절차가 진행 중으로, 앞으로도 디스커버리 절차를 적극적으로 활용하여 예외 없이 법적 조치를 취할 예정입니다. 콘텐츠를 직접 게시한 계정뿐만 아니라 댓글로 가담한 이용자도 그 대상에 포함됨을 명확하게 알려드립니다.

국내 플랫폼에서 활동하는 가해자에 대해서도 어떠한 합의나 선처 없이 끝까지 법적 책임을 물을 것입니다. 당사는 디시인사이드 갤러리(남자 연예인, 기타 국내 드라마, 2012 런던 올림픽, 2020 도쿄 올림픽, 걸스플래닛999 포함) 등 익명 플랫폼을 상시 모니터링하여 아티스트 관련 허위사실을 유포하거나 경멸적 표현으로 아티스트를 모욕한 자에 대해 정보통신망법위반, 모욕 등의 혐의로 고소장을 제출하였습니다. 그 외 다수의 악성 게시물에 대해서도 이미 증거 수집을 마치고 추가 고소를 앞두고 있습니다.

아울러, 이전에 고소한 사건 중 일부 피고인에 대하여 1심에서 정보통신망법위반(명예훼손) 및 모욕으로 유죄 판결이 선고되었습니다. 현재 항소심이 진행 중이며, 재판 중인 사건의 경우 판결에 영향을 미치거나 피고인에게 유리한 사정으로 원용될 여지를 차단하기 위하여 판결이 최종 확정되기 전까지는 구체적인 사항을 공개하기 어려운 점에 대해 너른 양해를 부탁드립니다.

당사는 'KWANGYA 119' 제보 내용을 바탕으로 현재도 실시간 채증 및 게시물 신고 등 조치를 취하고 있습니다. 확보된 자료는 게시물 삭제 또는 계정 탈퇴·비공개 전환 여부와 관계없이 수사기관에 증거로 제출되므로 어떠한 우회행위로도 책임을 피할 수 없음을 다시 한번 알려드립니다. 수사 및 재판 과정에 긴 시간이 소요되더라도, 아티스트를 대상으로 한 범죄행위에 대해 무관용 원칙에 따라 엄중하게 대응하겠습니다.
