@GunOwners This is also a way for them to collect member names because I am pretty positive. They will need proof of membership and if you live in a state that requires the registration requirements, they will deny applications to those members
@GunOwners This only helps maybe 27 states there are 15 states that this basically screwed GOA members because of the injunction, and the lack of knowledge of who the members are the ATF could refuse to process the paperwork to make sure they are in compliant with the court order
@Rep_Clyde@fourboxesdiner Well this screws all Washington state and similar members of the GOA and similar groups in other states that have laws like Washington in which to possess, make, purchase, or transfer suppressors illegal without the registration requirements.
@Rep_Clyde@Guns_Gadgets Rule making does not change the language in the law. They would have to remove section 5811(a) for this ruling to actually have proper effect. The judge got it wrong because there is language to change the tax value. If I was a judge, I would’ve ruled differently.

Some people already have registrations in process, and this ruling would effectively mess that up in states that require the NFA.
@Rep_Clyde@Guns_Gadgets It has to be done correctly through congress. This method would create a complete nightmare for people in states like Washington where the items with a $0 would be illegal without the registration requirements of the NFA.
Meaning the value of the tax can be changed on another reconciliation bill under a different administration or get snuck in on a bill trying to be passed.
@TheJusticeDept attorney Brett Shoemate is correct. The case involving suppressors in the fifth circuit needs to be appealed as Peterson is controlling president in that circuit. Additionally, the NFA is still valid and constitutional because it has taxing language.
