There were three options:

If Michael went through with the civil case, he’d have no chance at a fair trial since he would have revealed his defense in advance, which would allow his accusers to change their story based on his defense to better align with it and strengthen their case against him in the criminal trial.

If Michael plead the Fifth, the jury could have taken it as a sign of guilt, and since the burden of proof is lower in civil trials, the plaintiff’s claims are more easily accepted. Meaning they wouldn’t have needed much to secure a verdict against him.

If Michael settled, he would keep his defense (best case scenario), but the bigger price he paid is that it allowed the media to spin it as if he did it to avoid a trial.

He *literally* had no way out.
