Let’s go over some of the excuses why Schultz, Weiner and the so-called elected “leaders” in Sacramento refuse to make buying a 16 or 17-yr-old child an automatic felony:

-Eighteen-year-olds routinely pay their younger classmates $20 for sex in high school.

-This law will only affect people of color and/or people belonging to the LGBTQ+ community.

-We need to “deep dive into this issue” of protecting all minors and we must have full blown “informational hearings” about it in the fall.

-We already have laws on the books covering this.

-We refuse to draft a law protecting all minors but we will list that is our “intent.”

-The governor is spreading “misinformation.”

Before I go into why each of these excuses is complete & utter nonsense, I need to ask everyone who voted for these folks one question: Is voting for your party more important than protecting your children? Do you want an elected leader that represents you & your family or one who is beholden just to her/his party?

Let’s go:

-Dating relationships in high school don’t involve the exchange of money for sex. And even in Weiner’s universe where this happens in every high school across CA, no adult should be paying a minor for sex. Period. Check your moral compass.

-Sex trafficking involves all races, genders, nationalities, etc. This argument clearly shows the complete lack of understanding regarding how many innocent children have been victimized by trafficking and how this has negatively affected ALL in our country. Educate yourself if you are in charge of passing laws that affect all of us.

-What information does Schultz and Weiner need? Who is against protecting 16 and 17-yr-old children? Unless you are worried about the criminal, we don’t need any more information regarding the dangers of sex trafficking. This won’t change by the fall. How many more child victims do you need?

-Schultz allegedly said that PC 288 covers this type of conduct. PC 288 is lewd acts against a minor, not the paying of a 16 or 17-yr-old for sex. It also only covers children 15 and under. An “experienced prosecutor” would know this.

-If it’s your “intent” to protect 16 and 17-yr-olds, just pass the darn law. Stop playing politics with the safety of children.

-Just because it’s the truth doesn’t mean using phrases like “misinformation” will cover for your lies or trick the public. Do better.

If anyone in the Sacramento legislature wants to debate me regarding the protections of children in CA-anytime, anywhere.

Gabriel Daniel Fernandez was born on February 20, 2005.

Today would have been his 20th birthday. ❤️‍🩹

As a community, we should never forget Gabriel. When Gabriel needed it most, no one was there to hold him, to love him, to caress him, and to just tell him "everything will be alright." To me, however, Gabriel will always be an example of courage. His case, his life, his death, and his trial will always be with his family, with my family, and with the community. No matter what any one person tries to do, he will never be forgotten. He has made me a better person, a better father, and a better prosecutor.

I have tried to stay true to Gabriel's legacy by continuing the fight for justice for many more child victims. We all need to keep doing our part. Children are our future. They deserve and have a right to be safe at all times.

Celebrate Gabriel’s life. But also honor his legacy. If you see abuse, always say or do something. Don't remain silent. The safety of ALL children is everyone’s responsibility.
