The Law Society of Kenya strongly condemns the shocking arrest of Chief Justice Emeritus @dkmaraga and environmental activists protesting the irregular allocation of 76 acres of Nairobi National Park. Bundling a retired head of our Judiciary into a police vehicle for peacefully opposing a Sh42 Billion project, reportedly pushed through without public participation, is a direct assault on the civic space guaranteed under Article 37 of the Constitution. National heritage sites are not state property to barter behind closed doors.
The LSK will not stand by while police force is weaponized against constitutional defenders. We have immediately dispatched an LSK legal team to Lang’ata Police Station to secure the unconditional release of the activists, and I commend the CJ Emeritus for refusing to leave custody until all those arrested with him are freed. We demand an immediate end to the harassment of civic actors and a transparent public audit of the Bomas expansion plan. The Law Society of Kenya has received and is acting on reports that Nairobi Central OCS, Chief Inspector Dishen Ongoya, was arrested last night following his decision to consider charges and release 64 persons arrested during yesterday’s national stay-away. Our advocates are also attending to numerous other cases involving peaceful protesters currently before the courts.
An OCS is constitutionally and legally entitled to exercise discretion in the processing and release of arrested persons, subject to the law and the rights guaranteed under Article 49 of the Constitution. Punitive action arising from the lawful exercise of such discretion risks sending a chilling message to police officers tasked with upholding constitutional safeguards within the criminal justice process. - LSK President @ckanjama SC .
Today, some of the protesters(145), arrested during the recent fuel hike demonstrations, were arraigned at the Kibera Law Courts before Hon. Dr. V. Wakumile.
The protesters were previously arrested and held at Embakasi, Central, and Kasarani Police Stations in Nairobi.

The protesters faced charges of obstructing the operations of vehicles on the road, contrary to Section 58(c) of the Road Act.
Through the representation of our advocates, all the 145 were released on a cash bail of Kshs. 5,000, except for one minor who was granted a personal bond for the same amount.
The Independent Medico-Legal Unit (IMLU) is facilitating payment of the bail to secure their release. Mention dates have been set for 2nd and 4th June 2026.
The LSK reiterated its commitment to safeguarding constitutional rights and ensuring access to justice for all.
