The Government of India receives financial account information of Indian taxpayers from foreign countries under international information exchange framework.

To enhance transparency and provide better visibility, a new functionality has been introduced in the portal to allow taxpayers to view their foreign asset information.

Taxpayers can download the details in a password protected PDF, which contains year wise information starting from Calendar Year 2022 onwards.

The format of Foreign Assets report (in PDF) is as under:

Part A – General Information
1. Permanent Account Number
2. Name of Assessee

Part B – Calendar Year Specific Information
1. TSN (Transaction Sequence Number)
2. Country Name
3. Financial Institution Name (Reporting Entity Name)
4. Bank Account Number
5. Currency in which Income/Payments are reported (Column A, B, C and D)
6. Dividend
7. Interest
8. Gross Proceeds
9. Any Other Payments
10. In Indian Rupees (INR)
11. Account Balance (In Reported Currency)

सुप्रीम कोर्ट ने अपने एक महत्वपूर्ण फैसले में कहा है कि हिंदू उत्तराधिकार अधिनियम 1956 की धारा 22 के तहत मिलने वाला प्राथमिकता का अधिकार यानी पहले खरीदने का हक, कृषि भूमि यानी खेती की जमीन पर भी लागू होगा।

अदालत ने कहा है कि हिंदू उत्तराधिकार अधिनियम की धारा 22 जो क्लास वन उत्तराधिकारियों को किसी अन्य सह उत्तराधिकारी द्वारा ट्रांसफर की जाने वाली संपत्ति खरीदने की प्राथमिकता देने वाला अधिकार देती है, कृषि भूमि पर भी समान रूप से लागू होती है।

इसका मतलब है कि अगर परिवार में किस�� सदस्य को विरासत में ��मीन मिली है और वो अपने हिस्से को किसी बाहरी व्यक्ति को बेचना चाहता है तो उसे पहले अपने ही परिवार के अन्य क्लास वन उत्तराधिकारियों को मौका देना होगा।

हिंदुओं के पैतृक संपत्ति के अधिकार पर असर डालने वाला यह दूरगामी प्रभाव वाला फैसला न्यायमूर्ति संजय करोल और एन. कोटीश्वर सिंह ने महिंदर तथा अन्य बनाम पूरन सिंह मामले में सुनाया है।

कोर्ट ने महिंदर की अपील खारिज करते हुए पहली अपीलीय अदालत और ���ाई कोर्ट के फैसले को सही ठहराया है जिसने माना था कि धारा 22 कृषि भूमि पर भी लागू होगी।

इस मामले में याचिकाकर्ता और प्रतिवादी भाई-भाई थे जिन्होंने क्लास वन उत्तराधिकारियों की हैसियत से पिता की कृषि भूमि विरासत में पाई थी।

इनमें से कुछ उत्तराधिकारियों ने विरासत में मिली अपने हिस्से की कृषि भूमि मिल कर 28 दिसंबर 2011 को तीसरे पक्ष यानी श्रीमती पूनम को बेच दी।

लेकिन परिवार के एक ��न्य सदस्य ने इसका विरोध किया और हिंदू उत्तराधिकार अधिनियम 1956 की धारा 22 का आधार लेते हुए सिविल कोर्ट में वाद दायर कर बिक्री को चुनौती दे दी।

उसका कहना था कि धारा 22 के तहत उसे पहले खरीदने का अधिकार है। यानी बाहर वाले को बेचने से पहले परिवार को मौका मिलना चाहिए। सिविल कोर्ट ने यह कहते हुए वाद खारिज कर दिया कि कृषि भूमि पर ऐसा अधिकार लागू नहीं होता।
