@GardeeGodrich If the PFMA had no teeth, consequence management in the public sector would collapse. The real question is whether there was negligence or wilful non-compliance. That’s what the court must decide.
@GardeeGodrich Respectfully, that’s not how the PFMA is designed. Accounting Officers are legally responsible for the system of controls, including procurement andnot the day-to-day bidding itself. The law targets failure to prevent or act on irregularities, not simply “what juniors did”.
