It was lawful whether you like or not. ICE agents can legally disarm someone like Pretti during an encounter if they have reasonable suspicion the person is armed and dangerous while breaking the law.

The gun misfired, which happens all the time, so it’s all qualified immunity from there. Have all the tears and feelings you want but it won’t change the fact that it was a constitutional kill.

18 USC 111 makes it a federal crime to forcibly impede or interfere with officers while on duty.

Pretti broke the law by directing SUVs to form a barricade and block agents. Carrying a loaded firearm also legally triggers the deadly weapon enhancement under this statute since courts count possession during the forcible act as qualifying even if he didn't fire it.

Pretti was breaking the law, the gun misfired, and he was eliminated. ICE did nothing wrong.
