Mayor of Luther, OK under fire for signing NDA to build data center.

Luther Mayor Terry Arps signed a non-disclosure agreement with Beltline Energy in May 2025, about a year before the company formally filed an application tied to its proposed data center project.

The five-page agreement, signed May 29, 2025, is between Beltline Energy LLC and the Town of Luther. It was signed by Arps on behalf of the town and Ryan Sanders on behalf of Beltline Energy.

The NDA was signed after Beltline representatives met with Arps, Town Manager Scherrie Pidcock and Town Attorney Beth Anne Childs before a Board of Trustees meeting on May 29, 2025.

Beltline formally entered Luther’s development review process on June 2. The company filed a Special Use Permit application connected to its proposed data center project.

In a statement released by the Town of Luther, officials said the NDA applied only to proprietary information and emphasized that the town “did not/has not at any time received any proprietary information from Beltline.”
