Many may not understand why so many of us are waiting with baited breath to hear the outcome of the #BackPage trial. This has such long reaching ramifications for all of those involved. If you are reading my feed and don’t think it applies to you, you are wrong.
For those following the #Backpage trial, here is the latest. Today deliberations continue. As most know I have strong opinions as to how wrong this indictment actually is. #FreedomOfSpeech#ISupportLacey

At #BackpageTrial, jurors came back with a scary question. If a defendant is found not guilty on count 1, the conspiracy count, can he or she be “charged” on the 50 Travel Act counts. The lawyers were called in by the judge to discuss how to answer. The judge said she would interpret “charged” to mean “found guilty.” The lawyers debated, Judge Humetewa decided to answer “yes” and to point the jury to the jury instructions. Hold fast, amigos and amigas. And pray that the people on the jury understand that the defendants are being railroaded.
At #BackpageTrial in fed court in Phx, a bit of a bombshell. Defense attorney Gary Lincenberg asked the court to dismiss the case based on a late revelation of material that should have been disclosed to the defense as “Jencks material.” It’s a 91 page report created in part by the former IRS agent, Quoc Thai, who testified at trial. Lincenberg argued this material could have been used to impeach both Thai and the government’s star witness, Carl Ferrer. He told the judge the material is relevant and should have been disclosed. The judge looked pissed. AUSA Andy Stone tried a save, telling the judge that the document had information that had been previously disclosed to the defense. The judge ordered both sides to brief her on the matter by Monday. This is a very big deal. Stone said the document was sent to the prosecutors by Thai shortly after he testified. He said his side is disclosing it now because it relates to possible forfeiture proceedings if there’s a guilty verdict. But it’s an old document that details the tracing of assets, and the creation of holding companies. It also has past statements by Thai and Ferrer. The jury is still out. They’ll be at lunch soon. What if they come back with a verdict today? Also, I hate to be conspiratorial, but did the gvt do this on purpose? Are they trying to throw the game? I’m not sure. it’s either a glorious fuck up by our government or they’re doing this on purpose to save face. More likely the former. Jury doesn’t deliberate tomorrow, Friday, because it’s a federal holiday. And jury doesn’t deliberate on Monday because they only meet Tuesday through Friday. So if they conclude the day without a verdict, they won’t be back until Tuesday. there’s been a pattern of misconduct in this case. It includes the destruction of the Backpage website, and the DOJ memos, published by @reason magazine, which are not allowed into the case and are clearly exculpatory. Not to mention the mistrial the gvt caused in 2021. I’m completely disgusted by my government. I mean I didn’t have a lot of faith in it before this, but I have zero faith in it now.
