Now discovery has produced the records.
Government-produced records show information about ICE observers was entered into an existing federal investigative system:
ICM.
Agents collected photos, license-plate information and personal information.
They ran facial-recognition searches.
And some observers were labeled:
โTHREAT TO LAW ENFORCEMENT, PROFESSIONAL PROTESTOR.โ
Important distinction:
The evidence does NOT establish a separate DHS database specifically for protesters or โdomestic terrorists.โ
DHS says the conduct was isolated and contrary to department policy.
And no court has ruled the records unconstitutional.
But the evidentiary question has changed.
