❗️The President of the Constitutional Tribunal in Poland has just filed a notice to the prosecutor's office against Prime Minister D.Tusk and his government for the crime of acting in an organised criminal group with the aim of overthrowing the state system
A summary. When Tusk came to power:
1. He announced a “Nuremberg” for his opponents. Yes, he literally used the word “Nuremberg”.That is, hanging Nazis.
2.He took over the prosecutor’s office by force. He sent the police to take over the building without the president’s approval, which is required by law in Poland. He didn’t ask for it. He used force to do so.
3.The Supreme Court and Constitutional Tribunal ordered Tusk to reinstate the legal prosecutor general, but he said he will not execute this order. His exact words were: “We will take actions that may not fully comply with the letter of the law,” and, “I will make decisions with full awareness that they may not meet the standards of legal purists.”. Do you know any other European prime minister who openly admits to breaking the law and plans to keep doing it?
4. Tusk arrests people without fair trials and ignores parliamentary immunity, detaining two MPs in the presidential palace.
5.He did the same to another member of the parliament who had immunity from the Council of Europe – the last person to do this before him was Putin.
6.He harassed female civil servants in custody to force them to testify against his opponents. He treated these women, who had no criminal records, as terrorists, restricted their food, and allowed male guards to watch them doing physiological functions. This was confirmed in the special report done by their own Ombudsman .
7.He used strongmen from security agencies to take control of public media by force. Public media are given independence and have fixed-term mandates, but he ignored this and used police to block the buildings.
8.He also took over the courts. He sent armed police to the Judicial Council. He violated the term of office that guaranteed the independence of court leadership in Poland, and now he is manipulating judicial panels to imprison the opposition. In Poland we have a system of random judge assigments to ensure objectivity and independence. This is the law. Tusk simply excluded it. If a random draw selected a judge he didn’t like, he simply made it again until he got the one he wanted.
9.Tusk also covers up criminal cases involving his allies. He dismissed corruption allegations against the Senate speaker despite testimony from two hundred fifty people (the highest in Europe). He protected a minister accused of multimillion-euro corruption in a waste management scheme. Even if guilt has been admitted in this case it was covered up.
10. But, at the same time he removed the immunity of an opposition leader just because he threw away flowers that mocked his brother (former President of Poland).
11.Political parties in Poland are funded by the state. Tusk seized all funding from his main opposition, so in this year’s presidential election, he will receive fifty million złoty, while the opposition which is bigger than his party will get nothing.
12. The Supreme Court ruled that Tusk broke the law and ordered him to pay the opposition. He simply refused by posting this statement on X.
13. He has stopped publishing the rulings of the Constitutional Tribunal completely. I suggest looking at the opinion of the Venice Commission from last month, which says clearly that there is no reason to question the status of judges in Poland, and that not publishing the rulings of the Constitutional Tribunal is a crime. The same is true for not following the rulings of the Supreme Court.
14. The Parliament has withheld public funding for the constitutional bodies of the Constitutional Tribunal and the National Council of the Judiciary.
The Deputy Prosecutor General has just opened an investigation into Prime Minister Tusk's assault on the state system.
