After more than 40 NIL-related college sports reform bills and numerous hearings over six years, if Congress still doesn't have "clarity on" NIL, not sure it will suddenly emerge hours from a recess.
Class counsel is now saying publicly what the documents suggested all along. Shelquist: the NCAA excluded the 2022 class "knowing that they would likely win a TRO" for "political expediency to publicize the need for legislative action." Read that twice. The lawyer who just won the injunction believes the NCAA built a class of victims on purpose, expecting to lose in court, so the loss would sell a bill in Congress. That's the "somebody had to lose" argument solved. Nobody had to lose. Somebody was chosen to lose and it explains their doubling down last week despite mounting court losses. The 2022 class wasn't a transition problem the NCAA failed to fix. They were the exhibit in a lobbying campaign. And the bill gets its Senate vote this week.
