@CoffindafferFBI a mental institution wouldn’t be a walk in the park either. The burden would still be there to prove or disprove mental capacities at the time of the crime but we would still have the ability to attach a guilty or guilty with insanity clause instead of the not guilty label
@CoffindafferFBI I recognize that this could open a realm of issues for future cases and the potential for people trying to use an insanity defense to stay out of prison but I would beg to argue that while prison would undoubtedly be the worse end of a punishment stick,
@CoffindafferFBI Is it or should it be possible to consider guilty with insanity clause - this feels like we aren’t giving a non guilty verdict and there should be a punishment and penalty attached to it in title as well as a mental institution confinement to get the help needed
@CoffindafferFBI One thing I have wrestled with since this is such a controversial case….Regardless of which side of the possible verdicts you may sit on, many of us at the end of the day struggle with there needing to be some culpability in the fact that there are 3 innocent children gone.
