This is a commendable effort that unfortunately falls short. A national AI standard should protect at least as much as it preempts. This bill offers to override state laws without putting sufficient protections in their place.

It bars states from regulating the development of "any artificial intelligence model," yet only reaches the largest frontier developers and only the gravest risks, like weapons of mass destruction, large-scale cyberattacks, or loss of control over a model. States would lose the ability to address how AI systems are built, while the federal government would cover only the biggest companies and the most extreme harms. That is less protection, not more.

Just last week, Illinois passed one of the strongest AI safety laws in the country, with nearly unanimous bipartisan support. This bill would override laws like it. And because the real safety work happens in how a model is trained and built, a prohibition on regulating "development" reaches further than it sounds: it threatens state child safety and consumer protections, many of which can only be enforced by changing how a system is built.

The states are leading with strong protections. Congress should set a strong national floor that states can build on, not a ceiling that leaves us with less.
